Le Fantasia Design MEMBERSHIP AGREEMENT
1. Parties
a) This Le Fantasia Design Agreement (Agreement) is between the owner of the lefantasiadesign.com website, Le Fantasia Design (hereinafter referred to as lefantasiadesign.com) at İskenderpaşa mah.Aile Sok.No:31/4 Fatih/İstanbul and www.lefantasiadesign.com. It was concluded between the internet user MEMBER who became a member of the website on the date he approved the Membership Form.
2. Subject of the Contract
The subject of this Agreement is to determine the conditions for MEMBER to benefit and use the website www.lefantasiadesign.com owned by lefantasiadesign.com.
3. Rights and Obligations of the Parties
3.1. MEMBER accepts and undertakes to comply with all legal regulations and not to violate such provisions while using the www.lefantasiadesign.com website. Otherwise, the MEMBER will be fully and exclusively responsible for all legal and criminal liabilities that may arise.
3.2. MEMBER cannot engage in activities (spam, viruses, trojan horses, etc.) or transactions that prevent or make it difficult for others to use the services on the www.lefantasiadesign.com website.
3.3. MEMBER cannot use the www.lefantasiadesign.com website in any way that disrupts public order, is contrary to general morality, disturbs or harasses others, violates the intellectual and copyright rights of others, or for any illegal purpose.
3.4. The ideas and thoughts declared, written and expressions used by MEMBERS on the website www.lefantasiadesign.com are exclusively the MEMBERS' own personal ideas and comments, and only the MEMBER is responsible for the consequences of these ideas and comments. These views and opinions have no relation or connection with LE FANTASIA DESİGN. LE FANTASIA DESİNG has no liability for any damages that may be incurred by third parties or institutions due to the ideas and opinions expressed by the MEMBER, or for the damages that the MEMBER may suffer due to the ideas and opinions declared by third persons or institutions.
3.5. MEMBER declares and undertakes that the personal and other information he/she provided while becoming a MEMBER to the www.lefantasiadesign.com website is truthful and that LE FANTASIA DESİNG will compensate all damages incurred due to the untruth of this information, in full and in cash.
3.6. The MEMBER's right to use the password obtained from the LE FANTASIA DESİNG website belongs exclusively to the MEMBER. MEMBER cannot give this password to any third party. All legal and criminal liability regarding the use of the password belongs to the MEMBER.
3.7. LE FANTASIA DESİNG will not be held responsible for the seizure of MEMBER data by unauthorized persons and for any damage that may occur to MEMBER software and data. MEMBER has agreed in advance not to claim compensation from LE FANTASIA DESİNG for any damage he may incur due to the use of the www.lefantasiadesign.com website.
3.8. MEMBER has agreed not to access or use the information and software of other internet users without permission. Otherwise, the legal and criminal liability arising from this reason belongs entirely to the MEMBER.
3.9. The MEMBER who violates one or more of the articles listed in this Agreement accepts and undertakes that he/she will be responsible for all damages that may arise as a result and will keep LE FANTASIA DESİNG free from all damages, lawsuits, demands and allegations that may arise for this reason and will indemnify them against them.
3.10.LE FANTASIA DESING has the right to suspend or terminate the MEMBERSHIP of the MEMBER and delete all data, documents and files belonging to the MEMBER at any time unilaterally without assuming any liability.
3.11. All intellectual property rights regarding the www.lefantasiadesign.com website design and software and the text and visual content of the products are the property of LE FANTASIA DESİNG, and these cannot be used by the MEMBER without the written permission of LE FANTASIA DESİNG.
3.12. The name and Internet Protocol (IP) address of the Internet service provider used by LE FANTASIA DESİNG for the improvement and development of the www.lefantasiadesign.com website and/or to access the site within the framework of legal legislation, the date and time the site was accessed, the pages accessed while on the site, and Some information, such as the Internet address of the website that allows direct connection to the site, may be collected.
3.13.LE FANTASIA DESİNG may use the personal information of these MEMBERS in order to provide better service to its users, to improve its services and products, to facilitate the use of the site, in studies aimed at the interests and preferences of its users, provided that it obtains the prior consent of the MEMBERS. LE FANTASIA DESİNG reserves the right to keep a record of the MEMBER's movements on the website www.lefantasiadesign.com
3.14. MEMBER declares and accepts that he/she allows information and announcements to be sent to him/her about product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction practices of LE FANTASIA DESİNG and LE FANTASIA DESİNG brands within the scope of the practices in force and/or to be put into effect. MEMBER declares and accepts that he/she allows the personal and shopping information and shopping and/or consumer behavior information he/she has given in the past and/or will provide in the future while becoming a MEMBER to LE FANTASIA DESİNG and/or through other means to be collected, used and archived by LE FANTASIA DESİNG for the above purposes. MEMBER declares and accepts that he/she allows the data to be collected, used and archived by LE FANTASIA DESİNG, even after his MEMBERSHIP terminates, unless he states otherwise. MEMBER accepts and declares that he/she will not claim any direct and/or indirect material and/or moral, negative and/or positive, in short, any damage due to the collection, sharing, use, archiving and access of the above-mentioned information and will not hold LE FANTASIA DESİNG responsible. It does. If MEMBER wishes to change his data sharing preferences, he can forward this request to LE FANTASIA DESİNG's customer service call centers.
3.15. LE FANTASIA DESİNG may disclose the MEMBER's personal information to third parties (a) in case it is required to disclose it in accordance with the applicable laws or regulations or a court decision or administrative order, and (b) if the MEMBER consents.
3.16.LE FANTASIA DESİNG website has been taken within the available means to ensure that it is free of viruses and similar software. In addition, to ensure ultimate security, the user must supply his own virus protection system and provide the necessary protection. In this context, by entering the MEMBER LE FANTASIA DESİNG website, the MEMBER is deemed to have accepted that he/she is responsible for all errors that may occur in his/her software and operating systems and their direct or indirect consequences.
3.17. LE FANTASIA DESİNG has the right to change the content, design and software of the site at any time, to change, suspend or terminate any service provided to users and to delete user information and data registered on the website at any time.
3.18. LE FANTASIA DESİNG may update, change or repeal the terms of this Agreement at any time without the need for prior notice and/or warning. Each updated, changed or repealed provision will be valid for all MEMBERS on the date of publication.
3.19. In accordance with this Agreement, LE FANTASIA DESİNG is authorized to send informational e-mails to its MEMBERS' registered e-mail addresses and informative SMS to their mobile phones. By approving this Agreement, the MEMBER will be deemed to have consented to the sending of informational e-mails to his e-mail address and informative SMS to his mobile phone. If MEMBER wishes to give up receiving e-mail and/or SMS, he/she will be able to cancel e-mail and/or SMS sending by submitting this request to LE FANTASIA DESİNG Customer Services.
4. Termination of the Agreement Each Party may terminate this Agreement at any time by unilateral notification to the other party.
5. Settlement of Disputes
This agreement will remain in force until the MEMBER cancels his MEMBERSHIP or his MEMBERSHIP is canceled by LE FANTASIA DESİNG. LE FANTASIA DESİNG may unilaterally terminate the contract by canceling the MEMBERSHIP's MEMBERSHIP in case the MEMBER violates any provision of the membership agreement.
5. Settlement of Disputes
Istanbul Central Courts and Enforcement Offices are authorized to resolve all disputes related to or arising from this Agreement.
6. Enforcement
MEMBER'S MEMBERSHIP registration takes place when the MEMBER reads and accepts all articles contained in this Agreement. This Agreement has been concluded and entered into force at the time the MEMBER becomes a MEMBER.
